Welcome to VibeNude (the "Site", "Service", "we", "us", or "our"). These Terms of Use (the "Terms") form a legally binding agreement between you ("you" or the "User") and us.

By accessing, browsing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by all applicable laws and regulations. If you do not agree, you must not use the Service.

1. Service Description

VibeNude enables Users to upload images and generate AI-powered video content (the "AI-Generated Content") using advanced artificial-intelligence technology.

2. Eligibility

  • You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher).

  • You affirm that you are the depicted person in every image you upload.

  • You must not upload any content depicting other people without their explicit and verifiable consent.

3. User Accounts and Security

  • You may need to create an account to access certain features.

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

  • You must notify us immediately if you suspect any unauthorized access to or use of your account.

4. User Content

"User Content" refers to all images, data, videos, or other materials you upload or submit through the Service.

4.1 Your Representations

By uploading User Content, you represent and warrant that:

  • You own or control all necessary rights to the User Content.

  • You are the sole subject depicted, or you have legally valid consent from others who are depicted.

  • The content does not violate these Terms or any applicable laws or regulations.

4.2 License to Us

You grant us a limited, non-exclusive, royalty-free license to:

  • Host, store, modify, process, and generate AI-content from your uploads; and

  • Use your content solely for providing and improving the Service, security, and compliance.

We never share your User Content or AI-Generated Content with unauthorized third parties. All processing is private and solely used for providing the Service to you.

4.3 Prohibited Content

You may NOT upload or generate content that:

  • Depicts minors under 18 in any sexual or exploitative context.

  • Contains any person without their consent.

  • Includes violence, threats, hate speech, self-harm, terrorism, or unlawful acts.

  • Infringes intellectual-property or privacy rights.

  • Violates any law or regulation.

NSFW content featuring yourself is allowed where legal. You assume full legal responsibility for its use and sharing.

5. AI-Generated Content

  • AI-Generated Content may be imperfect, inaccurate, or unexpected.

  • We do not guarantee realism, accuracy, or suitability for any purpose.

  • Provided you comply with these Terms and pay any required fees, we assign all rights to your individual AI-Generated Content to you (excluding our models and underlying technology).

  • You bear full responsibility for how your AI-Generated Content is used, shared, or distributed.

6. Intellectual-Property Rights

VibeNude, including our software, technologies, and branding, are our exclusive property. Nothing in these Terms grants you any right to use our trademarks or proprietary systems without our prior written consent.

7. Fees and Payment

  • Fees for credits, subscriptions, or premium functionality must be paid in accordance with the pricing posted on the Service.

  • Fees are non-refundable except as required by applicable law.

7.1 Refund Policy

We do not issue refunds for:

  • Purchased credits (used or unused).

  • Subscriptions or one-time purchases.

  • AI-Generated Content results, regardless of quality or satisfaction.

Credit usage is final once consumed.

8. DMCA / Copyright Complaints

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted service, error-free operation, or defect-free results.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service. Your use of the Service is at your own risk.

11. Indemnification

You agree to indemnify and hold harmless VibeNude, its owners, operators, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your User Content.

  • Your use of the Service.

  • Your violation of these Terms.

  • Your violation of any law or third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for violations of these Terms or for any harmful or abusive behavior. Sections 4–13 of these Terms will survive any termination.

13. Modifications

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Service after any such updates constitutes your acceptance of the revised Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of Saint Vincent and the Grenadines, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation, and if necessary, in the competent courts of Saint Vincent and the Grenadines.
